Terms and Conditions

These Terms and Conditions set forth the operating procedures of the online store known as Party Savior, located at www.partysavior.pl, as well as the terms of use for the store.

These Terms and Conditions set forth the rights and obligations of the Store’s Customers, as well as the rights, obligations, and scope of liability of the Administrator as the entity that manages and operates the Store.

Every potential customer is required to review the Terms and Conditions and may proceed only after first agreeing to and accepting all of its provisions.

The owner of the Party Savior online store (www.partysavior.pl) is the following company:

I. GENERAL PROVISIONS

1. The provisions of these Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) apply to all contracts for the sale and delivery of goods concluded with partysavior.pl through the online store www.partysavior.pl (hereinafter referred to as the “Store”), regardless of the means of distance communication used in a given case to contact or conclude contracts between consumers and businesses without the physical presence of the contracting parties.

2. These Terms and Conditions apply to all registered and unregistered users of the Store (hereinafter referred to as “Customers”) and set forth the rules for registering and using a Store account, the rules for making electronic reservations for products available in the Store’s inventory, placing orders in the Store, and the rules for entering into Sales Agreements.

3. A prerequisite for using the Store and placing orders is that you read and accept these Terms and Conditions.

4. A customer may place an order without having to permanently register their information in the Store’s database, provided that they have read and accepted the provisions of these Terms and Conditions.

II. PLACING AN ORDER

1. The store sells merchandise exclusively online.

2. The store accepts online orders 24 hours a day, seven days a week. Orders are accepted at www.partysavior.pl

3. To place an order, select the products from the Store’s available selection, choose the sizes and quantities, and “add” them to your cart.

4. All prices are listed in zlotys and do not include VAT. The price listed for each item is binding from the moment the customer places an order (and it is confirmed) and does not change even if the prices of products in the Store increase.

5. Until the customer confirms the selection of ordered products by clicking the “Proceed to Checkout” button, the customer may make changes and modifications to the products in the order.

6. After confirming the ordered products, the Customer is required to provide their contact information (applies to unregistered Customers), the delivery method, and the payment method.

7. Shipping costs may be added to the order; these are specified during the ordering process.

8. When the Customer submits an order (by clicking the “Buy and Pay” button), this constitutes the Customer’s offer to enter into a sales contract, in accordance with the Terms and Conditions. Unregistered Customers must first review and accept the Terms and Conditions before placing an order.

9. The store accepts the following payment methods: instant transfer (HOTPAY), bank transfer, Blik, debit/credit card, or PayPal.

10. After placing an order, the Customer receives an email confirming that the order has been accepted, which constitutes confirmation of the conclusion of the sales contract.

11. For payments made by bank transfer, the funds must be credited to the Store’s bank account within 7 days of the order confirmation; otherwise, the order will be canceled.

12. Orders are processed within 10 business days of the payment for the order being credited to the Store’s bank account or of the order being confirmed in the case of payment by debit/credit card or PayPal.

13. The Store issues a VAT invoice for each order.

III. ORDER FULFILLMENT

1. Goods are delivered in the manner selected by the Customer and specified in the order.

2. The store is required to deliver the order to the buyer within a maximum of 14 days from the date the order is confirmed. If the seller fails to deliver the order to the customer within this period, regardless of the reasons for the delay, the customer has the right to cancel the contract. Upon receiving notice of cancellation from the customer, the Store has 14 days to refund the amount paid by the customer (including shipping costs).

3. If some of the items included in the order are unavailable, the Customer will be immediately notified of the order status and will decide how to proceed (partial fulfillment, extending the delivery time, or canceling the entire order).

4. In the event of circumstances that prevent the fulfillment of a placed order, the Store reserves the right to suspend its fulfillment and undertakes to notify the customer of the situation immediately.

5. If the Customer decides to cancel an order and has already made payment, an automatic refund of that amount, including shipping costs, will be issued within 14 days after the Store receives an email notifying it that the Customer has canceled the order. ​

IV. RETURN POLICY

1. The customer may withdraw from the contract without giving a reason by sending a statement to that effect within 14 days of the date of receipt of the shipment. The statement may be submitted in writing or via email sent to kontakt@partysavior.pl

2. In the case described above, the Customer is required to return the purchased goods immediately, no later than 14 calendar days from the date on which the Customer withdrew from the contract. The purchased goods must be returned to the following address:

3. In the event of a valid cancellation of the contract, the contract is deemed never to have been concluded, and the Customer is released from all obligations. If the return is made within the specified time frame, the Store guarantees a refund of the full amount via bank transfer to the Customer’s account.

4. The customer is responsible for the direct costs of returning the merchandise, including shipping costs. If the customer did not pick up the package, the refund amount will be reduced by the shipping cost.

5. Returned merchandise must not show any signs of use, and must not be damaged, soiled, or washed.

V. COMPLAINTS

1. The products offered in the Store are brand-new and manufactured upon order.

2. As the seller, the Store is liable to a Customer who is a consumer within the meaning of Article 221 of the Civil Code for any nonconformity of the Goods purchased by that consumer, to the extent specified in the Act on Specific Terms and Conditions of Consumer Sales and Amendments to the Civil Code of July 27, 2002. A complaint may be filed by mail by returning the goods along with a written description of the defect and proof of purchase via certified mail to the following address: Party Savior Julita Szpera, ul. 3. The customer will be notified of the outcome of the complaint within 14 days of the store’s receipt of the letter containing the item subject to the complaint. If a complaint submitted by mail is approved, the store will send the customer a product in perfect condition within 14 days.

4. If the complaint is not accepted, the merchandise will be returned along with a statement explaining why the complaint is unfounded, at the buyer’s expense. 

VI. PROTECTION OF PERSONAL DATA

1. In matters not covered by these Terms and Conditions, the provisions of the Civil Code and the Act of March 2, 2000, on the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product (Journal of Laws of 2000, No. 22, item 271) shall apply.

2. Personal data is collected by the Store in accordance with the provisions of the Personal Data Protection Act of August 26, 2002. Providing personal and address information constitutes voluntary consent to the processing of such data for marketing purposes exclusively by the Store.

VII. FINAL PROVISIONS

1. The court with jurisdiction to resolve disputes is the court with local jurisdiction under applicable law.

2. Polish law applies to the contract for the sale of products in the store. The contract is concluded in Polish.

3. In accordance with the Act of August 29, 1997 (Journal of Laws 1997, No. 133, item 833) on the protection of personal data, we hereby inform you that our customers’ personal data is stored in our company’s database. Personal data is collected solely for our own purposes and processed for the purpose of conducting the company’s statutory business activities, as well as carrying out promotional and advertising campaigns, in compliance with the data security requirements set forth in the regulations on the protection of personal data.

4. The Administrator reserves the right to amend the provisions of these Terms and Conditions in particularly justified cases, including:

(a) to bring them into compliance with generally applicable laws,

(b) in order to eliminate any provisions that might harm the interests of Customers,

(c) in connection with a change or expansion of the range of services and goods offered by the Store,

(d) due to a change in the nature of the business.

5. The changes referred to in paragraph 4 do not apply to Customers who placed an order before the changes to the following terms and conditions took effect, unless such changes result from mandatory provisions of law. The Customer will be notified of any changes to the terms and conditions via the email address provided when placing the order.

6. In the event of changes to the Terms and Conditions, the Store will immediately notify Customers by publishing the consolidated text of the Terms and Conditions on the website www.partysavior.pl and by sending a notification to the email address provided by the Customer. The Customer (applies to registered customers) must accept the changes if they wish to continue using the Store’s services.

7. These Terms and Conditions take effect on the date they are posted on the Store’s website.

8. In the event that any provision of these Terms and Conditions is amended or invalidated as a result of a final court ruling, the remaining provisions shall remain in effect and binding on the parties.
